1. OVERVIEW

2. TELLING

2.1 You can order products from our online shop without registering, but registered users may be entitled to additional benefits. The system is secure and convenient to use, and your personal data is protected with us.

2.2 In order to place an order, you must complete the following steps:

1) Add the appropriate product(s) to your shopping cart;

2) Go to the shopping cart by clicking on the shopping cart button at the top of the page;

3) Fill in the requested fields, select the appropriate transport and payment method;

4) Read the Terms and Conditions of Purchase and Sale and, if you agree, confirm your acceptance;

5) Click on the “Place Order” button and make the payment for your order.

Now all you have to do is wait for your order confirmation to arrive by email and for your order to be processed.

3. PAYMENT

3.1 After you have paid for your purchase, be sure to click on the “Back to merchant” button.

3.2 You can pay for your order quickly and securely via bank links, hire purchase partners and invoice/e-invoice from our website.

3.2.1 We support the following bank links: Swedbank, SEB, LHV bank, Luminor bank and COOP bank. Payments are processed by the Montonio payment intermediary service.

3.3 The order will be processed as soon as 100% of the payment made by you has been credited to the current account.

3.4 The Buyer shall bear the service charges related to payments.

4. DELIVERY TO

4.1 Once you have successfully paid for your goods, you will receive a confirmation e-mail with detailed information. If you haven’t received this letter, be sure to contact customer services. Your order will then be processed. Once the goods have been packed, they will be shipped to you and you will immediately receive an e-mail saying “Your order has been shipped”.

4.1.1 NB! There is no dispatch/receipt on public holidays.

4.3 In the event that the customer does not collect the parcel on time and it is returned to Medifum Group OÜ, the customer is responsible for the costs associated with returning the parcel and, if requested, the cost of re-delivery. If the customer has ordered the goods to be delivered to the agency, the customer is obliged to collect the goods within 3 calendar months. In case of non-delivery, the order will be cancelled and the amount paid for the order will not be refunded.

5. RIGHT OF WITHDRAWAL

5.1 The Customer has the right to withdraw from the contract and exchange or return the goods within 14 days of receipt of the ordered goods without giving any reason. In the event of withdrawal from the contract, the customer must return the goods immediately, but not later than 14 days.

5.2 Goods may be sampled and inspected to ascertain their suitability or unsuitability, but the sampling must ensure that the goods and their packaging are affected as little as possible. Trying on means the equivalent of using the product in a retail shop before making a purchase.

5.3 The returned product must be in the original packaging, with the original labelling and in the same condition as at the time of delivery to the customer. If it is possible to open the packaging of the goods without damaging the packaging, the customer undertakes to open the packaging in this way. If the original packaging of the goods is damaged or if the use of the goods during the trial period exceeds the reasonable extent necessary to familiarise oneself with the goods, or if the goods to be returned are not in a similar condition to new goods of the same type, the Seller is entitled to unilaterally deduct from the amount to be returned to the Customer a compensation corresponding to the reduction in the value of the goods. The amount of the compensation shall be determined on a case-by-case basis, taking into account the extent of the possible reduction in the value of the returned goods, and the customer shall be informed of the amount of the compensation as soon as possible after the amount of the compensation has been determined.

5.4 The cost of returning the goods shall be borne by the Buyer, unless the reason for returning the goods is that the goods to be returned do not correspond to what was ordered (e.g. wrong or defective goods).

5.5 The Buyer must return the Goods within 14 days of the date of the application or provide proof that he has delivered the Goods to the carrier within the aforementioned period.

5.6 Upon receipt of the returned goods, the online shop will immediately, but not later than 14 days after receipt of the withdrawal, return to the buyer all payments received from the buyer under the contract.

5.7 The online shop may refuse to make refunds until it has received the goods that are the subject of the agreement or until the buyer has provided proof that it has returned the goods, whichever is the earlier.

5.8 If the buyer has expressly chosen a delivery method other than the cheapest delivery method offered by the Online shop, the Online shop is not obliged to refund the consumer the cost that exceeds the cost of the usual delivery method.

5.9 The online shop has the right to withdraw from the sales transaction and to demand the return of the goods from the buyer, if the price of the goods in the online shop has been marked significantly below the market price of the goods due to a mistake.

5.11 After submitting the application, you can send the goods to Nurmenuku Smartpost, DPD or Omniva parcel service at +372 5301 6292, or in case of a larger item, return it to our office at Meistri 16-101, 13517 Tallinn.

5.12 The time limit for lodging complaints is 2 years. It should be borne in mind that if a defect appears in the goods within 6 months of purchase, it is presumed to have existed at the time of purchase unless the seller proves otherwise. After a period of 6 months from the purchase of the goods, it is up to the consumer to prove that it is a manufacturing defect and not a defect caused by the consumer’s own misuse.

5.13 In the event of a defect, the Buyer has the right to contact the online shop within two months at the latest by sending an e-mail or by calling +372 5301 6292. The online shop will respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.

5.14 If the ordered goods cannot be delivered due to expiry of the goods or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded, usually within 1-2 working days. Depending on the payment method, it can take up to 7 working days to receive your payment.

6. ANDMECAFTS

6.1 The personal data of the client is processed in accordance with the Personal Data Protection Act.

6.2 Medifum Group OÜ collects the Consumer’s personal data when creating a customer account and/or placing an order.

6.3 The personal data processed are the Consumer’s name, e-mail address, mobile phone number and preferences.

6.4 Medifum Group OÜ uses personal data for the purpose of providing, developing and personalising services to the Consumer. These services should be understood in particular as the sale of goods to Consumers in the online shop and the organisation of personalised offers.

6.5 By entering the data in the online shop and with the corresponding confirmation, the Consumer grants the right to collect and process the Consumer’s personal data and to forward the data necessary for the delivery of the goods to the logistics partner.

6.6 Medifum Group OÜ has the right to use the Consumer’s home or business address for advertising and other information to the Consumer.

6.7 The consumer has the right at any time to object to the collection and use of their personal data, except where this is necessary for the recovery of a claim arising from the contract or for the delivery of the goods. Consent to the use of personal data cannot be withdrawn retroactively.

6.8 The use of electronic personal data for direct mailing purposes will only take place if the Consumer has consented to this on the Medifum Group OÜ website.

6.9 Encrypted data communication with banks when paying for purchases ensures the security of the Consumer’s personal banking details, which Medifum Group OÜ does not have access to.

6.9.1 Medifum Group OÜ will not disclose personal data received about the Client to third parties.

6.10 Medifum Group OÜ shall have the right to forward the customer’s Facebook Messenger campaigns, news and notifications related to orders.

7. OTHER CONDITIONS

7.1 LIABILITY AND FORCE MAJEURE:

7.1.1 Medifum Group OÜ shall be liable to you and you shall be liable to Medifum Group OÜ for any damage caused to the other party by breach of these Terms and Conditions in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.

7.1.2 Medifum Group OÜ shall not be liable for any damage caused to you or any delay in delivery of the Product if the damage or delay in delivery of the Product is due to a circumstance beyond Medifum Group OÜ’s reasonable control and which Medifum Group OÜ did not foresee and could not have foreseen (force majeure).

7.2 BREACH OF OBLIGATIONS:

7.2.1 Breach of Obligations means failure to comply with the terms of the Order or failure to comply with the terms of the Order, including delay in performance.

7.3 REMEDIES FOR BREACH OF OBLIGATIONS:

7.3.1 If the online shop is in breach of its obligations, the customer may:

1) require performance of an obligation;

2) refuse to perform an obligation owed by you;

3) claim damages;

4) withdraw from or cancel the contract;

5) lower the price;

6) in the event of delay in the performance of a financial obligation, to charge default interest.

7.3.2 In the event of a breach of an obligation, the Customer may exercise, separately or in combination, all remedies available under the law or the Contract, which may be exercised simultaneously, unless the law or the Contract provides otherwise. In particular, the exercise of a remedy for breach of an obligation does not deprive the customer of the right to claim damages for the loss caused by the breach.

7.3.3 The Client may not rely on a breach of obligation by Medifum Group OÜ or exercise any remedy in respect thereof to the extent that the breach was caused by its own act or by a circumstance or event attributable to it and the risk of which it bears.

8. COUPONS, PROMOTIONAL CODES AND REWARD POINTS

8.1 Coupons and promotional codes can be used by all users, provided that the user has received it.

8.2 Coupons and promotional codes will be distributed on medifum’s Facebook fan page and, in the case of a subscribed user, by e-mail.

8.3 To use a coupon or promotional code, you must add the products you wish to purchase to your shopping cart, enter the code in the promotional code field in the shopping cart and click on LISA, the system will automatically calculate the discount.

8.4 Coupons and promotional codes have an expiry date and this information can be found at the moment you receive the coupon.

8.5 Two coupons cannot be used at the same time.

8.6 The coupon can be used as an additional discount on the discounted product if the coupon allows it.

8.7 Reward points will be earned by each user without registration, on an e-mail basis. If the subscriber’s e-mail address is different for different orders, the points will also accumulate on different accounts. It is safer to register an account so that points are not scattered across different emails.

8.8 The probability of earning reward points is 10 points for every €1 spent.

8.9 Reward points are used as a co-benefit, 100 points will give you €1 shopping cart.

8.10 Prize points will be rounded up from the total to half a whole number.

8.11 Reward Points cannot be redeemed for cash or exchanged for discount vouchers.

8.12 Reward points expire within 3 months.

8.13 By registering an account you will earn 200 reward points (2€) towards your next order.

8.14 Reward points can be used up to 50% of the basket amount at any one time.

9. CUSTOMER RIGHTS IN DISPUTE RESOLUTION

9.1 Issues not specifically resolved in these Terms and Conditions shall be governed by the legislation in force in the Republic of Estonia.

9.2 In order to resolve a dispute, the customer may contact the European Union Consumer Dispute Resolution Platform(https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=ET), the Office of Consumer Protection and Technical Regulation(https://www.ttja.ee/et/tarbijale/kaebuse-esitamine) or the courts.
